Texas is the only state in the country with an active Medical Disclosure Panel. This nine-member committee establishes what risks a reasonable patient would want to know when considering hundreds of different surgical procedures and medical treatments.

There are two facets to this unique Texas requirement. First, the procedure-specific, standardized disclosure process arguably results in patients who are more knowledgeable about the potential risks associated with their treatment options. This may yield fewer medical liability claims as patient expectations more closely align with the range of potential surgical complications. The second facet of this Texas requirement is the administrative and clerical burden placed on providers. Hospitals must stay current on the ever-changing lists of procedures requiring detailed disclosure and their attendant risks while also ensuring that the correct information is accurately communicated to every patient.

Because of the complexities of this unique state requirement, the informed consent process has not migrated from a paper-based interaction with the rapidity of other clinical processes. This session with examine strategies for leveraging technology to support this legal and ethical requirement. Evidence will also be presented to show that use of the documentation generated by this process can play a significant role in reducing the risk of errors, specifically the incidence of wrong-patient/wrong-procedure/wrong-site surgery.
